Extraordinary Ability Visa Attorneys in Florida

Individuals with extraordinary abilities in sciences, arts, education, business or athletics may be able to obtain EB1(1) immigrant visas if they can prove they are at the top of their field, a feat that can be very difficult to do without the assistance of a knowledgeable lawyer. To be eligible for an EB-1(1) visa, a foreigner must have received an international award for his or her work — such as an Olympic Medal, an Oscar, a medical fellowship or a Pulitzer Prize — or have met certain qualifications set forth by the U.S. government. The U.S. Citizenship and Immigration Services website lists the criteria as:

  • Evidence of the receipt of lesser nationally or internationally recognized prizes or awards for excellence
  • Evidence of membership in associations in the field where outstanding achievements are prerequisites
  • Evidence of published material about you in major media or professional or major trade publications
  • Evidence of your being asked to judge the work of others on an individual basis or as part of a panel
  • Evidence of your original scientific, scholarly, artistic, athletic or business-related contributions of major significance to your field
  • Evidence of your authorship of scholarly articles in professional or major trade publications or other major media
  • Evidence that your work has been displayed at artistic exhibitions or showcases
  • Evidence of your performance of a critical or leading role in a distinguished organization
  • Evidence you command a high salary or other significantly high remuneration in relation to others in the field
  • Evidence of your commercial successes in the performing arts

Skilled professors, researchers, and multinational managers or executives are also eligible for visas on the basis of their accomplishments. Approved EB-1(1) petitions do not require a labor certification or job offer from an employer and, once granted, there is no expiration date.
